Purchase Credits Terms & Conditions

These Terms and Conditions ("Credit Terms") govern your purchase and use of top-up credits ("Credits") on the Cascade AI platform ("Platform"), operated by Nitro Theory Limited ("Cascade", "we", "us", "our"), a company registered in England and Wales with company number 16619269, whose registered office is at 38 Newberries Avenue, Radlett, WD7 7EP, United Kingdom.These Credit Terms form part of our general Terms of Service https://cascadestudio.ai/terms. By purchasing Credits, you agree to be bound by these Credit Terms in addition to our general Terms of Service. If you do not agree, do not purchase Credits.These Credit Terms are intended to comply with the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the Digital Markets, Competition and Consumers Act 2024.

1. Definitions
In these Credit Terms:•      
"Credits" – means the prepaid virtual currency units purchased through the Platform, which can be redeemed to generate AI-produced content using Cascade’s tools and models.•      
"Credit Balance" – means the total number of unused Credits held in your Account at any given time.•      
"Expiry Date" – means the date on which a batch of purchased Credits expires, as set out in clause 5.•      
"Generation" – means a single instance of AI-produced content (image, video clip, or other output) produced by the Platform using Credits.•      
"Account" – means your registered user account on the Platform.•      
"Consumer" – has the meaning given in the Consumer Rights Act 2015: an individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.•       "Business User" – means any user who is not a Consumer.

2. Nature of Credits
2.1  Credits are a prepaid virtual currency for use exclusively on the Platform. They are not legal tender, have no monetary value outside the Platform, and cannot be transferred, sold, or exchanged between users.
2.2  Credits are not a financial product, electronic money, or regulated credit instrument. They do not accrue interest and cannot be used as payment for any purpose other than generating content on the Platform.
2.3  Any content generated using Credits that were themselves purchased with money is subject to the digital content quality standards set out in Part 1 of the Consumer Rights Act 2015 (satisfactory quality, fitness for purpose, and conformity with description).

3. Purchasing Credits
3.1  Credit Packs are available as follows:

All prices shown include Value Added Tax (VAT) at the applicable rate.
3.2  Credit cost per generation: The number of Credits consumed per Generation depends on the model selected, output resolution, clip duration, and any premium features used. Before each Generation, the Platform will display the exact Credit cost. You will not be charged Credits without your confirmation.
3.3  Payment is processed at the time of purchase. Credits are added to your Account immediately upon successful payment confirmation.
3.4  We accept the debit and credit card payments through the integrated “Stripe” platform. All transactions are processed securely. We do not store your full payment card details.

4. Cooling-Off Period and Right to Cancel (Consumers Only)
4.1  If you are a Consumer, you have the right to cancel your Credit purchase within 14 days of the date of purchase (the “Cooling-Off Period”) under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, without giving any reason.
4.2  IMPORTANT – Waiver of Cooling-Off Right: If you use any Credits before the Cooling-Off Period expires, you expressly consent to the immediate performance of the contract and acknowledge that your right to cancel is lost in respect of the Credits used. By clicking “Purchase” and then using a Credit, you confirm this consent.
4.3  If you cancel within the Cooling-Off Period and have not used any Credits, you are entitled to a full refund of the purchase price. If you cancel within the Cooling-Off Period having used some Credits, you are entitled to a pro-rata refund for the unused Credits only.
4.4  To exercise your right to cancel, please contact us at support@cascadestudio.ai before the end of the Cooling-Off Period.
4.5  Business Users do not have a statutory cooling-off right in respect of Credit purchases.

5. Credit Expiry
5.1  Purchased Credits expire 12 months from the date of purchase (the “Expiry Date”). Credits are non-refundable after expiry unless otherwise required by law.
5.2  Your Expiry Date for each Credit batch is shown in your Account dashboard under “Credit History”.
5.3  Reminder notifications: We will notify you by email at 30 days and 7 days before your Credits expire. It is your responsibility to ensure your registered email address is correct and up to date.
5.4  Credits are consumed in order of earliest Expiry Date first (FIFO basis).
5.5  We reserve the right to change the Expiry Date policy on future Credit purchases with no less than 30 days’ prior written notice. Any change will not affect Credits already purchased.

6. Failed Generations and Credit Restoration
6.1  If a Generation fails due to a technical fault attributable to Cascade (for example, a server error, a processing failure, or a platform outage), the Credits consumed for that Generation will be automatically restored to your Credit Balance within 72 hours.
6.2  Credits will not be restored where a Generation fails or produces unsatisfactory output due to:
•       Your prompt or input violating our Content Policy;
•       Your device, browser, or internet connection;
•       You cancelling a Generation in progress;
•       The output being of a style or aesthetic you did not prefer (where the output otherwise meets quality standards).
6.3  If you believe Credits have been incorrectly deducted or not restored after a platform fault, please contact us at support@cascadestudio.ai within 3 days of the failed Generation, providing your Account details and the Generation ID.

7. Refunds
7.1  Subject to clause 4 (cooling-off) and your statutory rights, Credits are non-refundable once purchased and used.
7.2  Any refund we are required to provide will be processed within 14 days of our agreement that a refund is due, using the same payment method used to purchase the Credits. We will not refund Credits by crediting your Credit Balance.
7.3  If Cascade ceases to operate the Platform, or permanently discontinues the Credit system, we will notify you at least 30 days in advance and provide a monetary refund for any unused Credits at their face purchase value.

8. Pricing, VAT, and Changes
8.1  All Credit prices are displayed inclusive of VAT at 20% (or the applicable rate) at the time of purchase.
8.2  The Credit cost per Generation (the number of Credits consumed) may change. We will give you no less than 14 days’ prior notice of any increase to Credit consumption rates via email and in-Platform notification. Changes will not apply to Credits already purchased.
8.3  We may change the price of Credit packs for new purchases at any time. Such changes will not affect Credits already purchased.

9. Account, Security, and Non-Transferability
9.1  Credits are personal to you and are linked to your Account. They cannot be transferred to another Account, sold, gifted, or otherwise disposed of to a third party.
9.2  You are responsible for maintaining the security of your Account. We are not liable for Credits used by any unauthorised third party who gains access to your Account due to your failure to keep your login credentials secure.
9.3  In the event of unauthorised use of your Account, please contact us immediately atsupport@cascadestudio.ai. We will investigate and, where we determine Credits were consumed due to unauthorised access with no fault on your part, we may at our discretion restore those Credits.

10. Account Suspension and Termination
10.1  If we suspend or terminate your Account for breach of our Terms of Service or Content Policy, unused Credits will be forfeited without refund, subject to your statutory rights as a Consumer.
10.2  If you choose to close your Account, any unused Credits will be forfeited. We recommend you use all Credits before requesting Account closure.
10.3  Nothing in this clause limits your statutory rights under the Consumer Rights Act 2015 or any other applicable law.

11. Limitation of Liability
11.1  Nothing in these Credit Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
11.2  Subject to clause 11.1, and to the fullest extent permitted by law, our total liability to you in connection with Credits shall not exceed the total amount paid by you for Credits in the 12 months preceding the event giving rise to the claim.
11.3  If you are a Consumer, these Credit Terms do not affect your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

12. Complaints and Dispute Resolution
12.1  If you have a complaint regarding Credits, please contact us in the first instance atsupport@cascadestudio.ai. We aim to respond within 10 business days.
12.2  The EU Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr/ (note: this applies to UK consumers buying from UK traders only where applicable).

13. Governing Law and Jurisdiction
13.1  These Credit Terms are governed by the laws of England and Wales.
13.2  Any dispute arising out of or in connection with these Credit Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a Consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of your country of residence.
14. Changes to These Credit Terms

14.1  We may update these Credit Terms from time to time. We will give you no less than 30 days’ prior notice of any material changes by email and by displaying a prominent notice on the Platform.
14.2  Your continued use of Credits after the effective date of any changes constitutes your acceptance of the revised Credit Terms. If you do not accept the changes, you may request a refund for any unused Credits purchased before the effective date of the changes by contacting us at support@cascadestudio.ai.
